Terms of Service

1. Agreement

These Terms govern your use of Quote Monster, provided by [legal entity name] ("we", "us"). By subscribing or using the service you ("the Customer") agree to these Terms.

2. The service

Quote Monster is a hosted, branded quoting tool. Under our managed service we set up and host an instance for you, load your price list, and provide updates and support per your plan. Features depend on your plan (Standard or Pro).

3. Fees & billing

• A one-off setup fee is payable before delivery.
• Subscription fees (monthly or annual) are billed in advance via Stripe and renew automatically until cancelled.
• Fees are in Euro and exclusive of VAT where applicable.
• You may cancel at any time; the service continues until the end of the paid period. Fees already paid are non-refundable except where required by law.

4. Your responsibilities

• Keep your pricing, margins and quote content accurate — you are responsible for the quotes you produce and send.
• Back up your data. App data is stored in your browser (localStorage); use the export feature regularly. We are not responsible for data lost through your browser, device, or actions.
• Use the service lawfully and not in any way that infringes others' rights.
• Where you enter your own customers' personal data, you are the data controller of that data (see our Privacy Policy) and are responsible for having a lawful basis to process it.

5. Grant & calculation estimates

Grant figures (SEAI, TAMS 3, and others), VAT, ROI and other calculations are estimates for guidance only and depend on inputs you provide and on third-party scheme rules that change. They are not financial, tax, or legal advice and are not guaranteed. You are responsible for verifying figures before relying on or sending them. Grant approval is determined solely by the relevant authority.

6. Intellectual property

We retain all rights in the Quote Monster software and brand. You retain all rights in your own content (your pricing, quotes, logo and customer data). We grant you a non-exclusive, non-transferable licence to use the service for the duration of your subscription.

7. Availability & warranties

We aim for high availability but the service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, business, data, or goodwill. Our total liability arising out of or in connection with the service shall not exceed the fees you paid in the [3] months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

9. Termination

Either party may terminate with [30] days' notice. We may suspend or terminate immediately for non-payment or material breach. On termination we will, on request, provide a final export of your data, after which we may delete it.

10. Changes to these Terms

We may update these Terms; we will give reasonable notice of material changes. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction.
